Section 1. Who this agreement is with

Sketch Anything is made by Implicit Labs, Inc., and in this document “we”, “us” and “our” mean Implicit Labs, Inc. — “you” means the person using the app or this website. “The service” means the Sketch Anything mobile app, this website, and the servers behind them.

Using the service means you accept this agreement. If you do not accept it, do not use the service.

Two other documents sit alongside this one and form part of the agreement: the privacy policy, which explains what we do with personal information, and the data use policy, which sets out every category of data and what happens to it.

Section 2. Who may use the service

An account holder must be a parent or guardian who is 18 or older. Signing up asks you to confirm that, and we record the confirmation. You hold the account, you agree to these terms, and you are responsible for everything that happens under it.

Children use Sketch Anything under a parent’s or guardian’s account, or as a guest, and with that adult’s supervision. Children do not hold accounts of their own. If you set the app up for a child, you are agreeing to these terms on your own behalf, and you decide what the child may do with the service.

We do not knowingly collect personal information from children. The privacy policy says what we do if we learn that we have, and how to ask us to delete it.

Section 3. Your permission to use the app

While you keep to this agreement, we give you permission to install and use Sketch Anything on devices you own or control, for your household’s personal, non-commercial use. The permission is personal to you, it is not exclusive, and you cannot transfer it to anyone else.

We keep everything else. You do not get any ownership of the app, the website, our name or our artwork, and nothing here gives you rights in the pictures the app finds for you — those belong to the people who made them, and Section 6 explains what that means in practice.

Section 4. Using the service properly

Use Sketch Anything lawfully, and respect the people whose pictures you find with it. In particular, do not:

  • try to get around Safe Search, the blocked-word list, or any other content filter;
  • use the service to look for, make, or store material that is unlawful, or that is unsuitable for the children this app was built for;
  • upload a photo you do not have the right to use, or a photo of somebody who has not agreed to it;
  • copy, scrape, resell or redistribute the service, or use it to build a competing product;
  • take the service apart, work backwards from it, or try to get at the source code, except where the law says you may;
  • break into, overload, probe or disrupt the service, or use an automated tool against it without our written permission;
  • file reports you know to be false, or abuse the reporting tools.

We may limit, suspend or end access to an account that breaks this section, and we may remove content that breaks it.

Section 5. Your account

You can search, draw and trace as a guest. Saving pictures to My Images needs an account, and so does Create with AI.

Give us an email address that works and keep your password to yourself. You are responsible for what happens under your account, so tell us straight away if you think somebody else has got into it. We may ask you to reset your password if we believe an account has been compromised.

Section 6. Pictures from the image sources

Search results come from third-party image sources. We index what they publish and show it to you. We do not own those pictures, we do not grant you any rights in them, and we do not promise that what a source says about a picture is correct.

Every picture carries its own licence. The preview screen shows the source, the licence and, where the source supplies it, the creator, and “View source” opens the original page. Check the licence before a picture goes anywhere beyond your own sketchbook — what the sources allow is set out on the image sources page. How you use a picture is your responsibility.

If you made a picture the app is showing and you want it out of the app, tell us — Section 9 explains how.

Section 7. Create with AI

Create with AI is part of Pro. You give it a description or a photo, and an image-generation provider makes a picture for you to draw.

  • What comes back is not guaranteed. Generated pictures are made by a model, not by a person. They may be inaccurate, odd, or similar to a picture somebody else was given, and we do not promise that any of them is unique or fit for a particular purpose.
  • Only send a photo you are allowed to use. Do not send a photograph of another person without their agreement, or a child’s photograph unless you are their parent or guardian.
  • Prompts are checked. What you type is checked against a blocked-word list before anything is made, and every style is built around a description that asks for something plain, friendly and suitable for young children. Do not try to make anything unsuitable for a family audience.
  • We may limit it. There is a daily allowance, and we may change it, pause the feature, or withdraw access from an account that misuses it.

What the providers receive, and what they do with it, is set out in the data use policy.

Section 8. Your content

“Your content” means the things you put into the service or make with it: the pictures you save to My Images, the pictures Create with AI makes for you, the way you position a picture for drawing or tracing, and the messages you send us.

Your content stays yours. To run the service we need your permission to host it, store it, copy it for backup, convert it into the formats the app uses, and show it back to you on your devices. That permission is limited to running the service, it lasts only as long as we hold the content, and it ends when you delete the content or your account.

We do not publish your content, we do not sell it, we do not use it for advertising, and we do not use it to train AI models.

Section 9. Copyright complaints

If you believe something on the service infringes your copyright, write to the support address, [email protected], with the subject “Copyright”. It is the same address for asking us to take a picture you made out of the app — Section 8 of the image sources page. Please include:

  1. your physical or electronic signature;
  2. what work you say has been infringed;
  3. what is on the service that you are complaining about, and enough detail for us to find it;
  4. your address, telephone number and email address;
  5. a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law;
  6. a statement that the information in your notice is accurate, and a statement under penalty of perjury that you are the copyright owner or authorised to act on the owner’s behalf.

We look at every notice. Where a complaint is well founded we remove the material or block access to it, and where the picture came from one of the image sources we tell that source as well. We may suspend or close an account that infringes repeatedly.

If we have removed something of yours and you believe that was a mistake, write to the same address with a counter-notice: your signature, what was removed and where it was, a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification, your name, address and telephone number, and your consent to the jurisdiction of the federal court for the district where you live, or of the state and federal courts located in California if you live outside the United States.

Section 10. Pro subscriptions and billing

Sketch Anything is free to search, save, draw and trace. Pro adds Create with AI.

Pro is not on sale yet. When it goes on sale it will be sold as an automatically renewing subscription through the App Store and Google Play, and this is how it will work:

  • Before you buy, the store shows the price, the currency, the length of the billing period and the fact that the subscription renews on its own. Prices are also on the pricing page. We do not take payment ourselves and we never see your card details.
  • Renewal. The subscription renews automatically at the end of each period, at the price the store showed you, and keeps renewing until it is cancelled.
  • Cancelling. You cancel in the subscription settings of the store account that bought it — Apple’s or Google’s, not ours — and the stores ask you to do it at least 24 hours before the period ends. Cancelling stops the next renewal. Pro keeps working until the period you have already paid for runs out.
  • Refunds are handled by the store, under the store’s own policy. We cannot issue a refund for a purchase we did not take.
  • Price changes are made through the store, which tells you before a new price applies and asks you to agree where its rules require it.

We can also grant Pro to an account directly, at no charge. Comped access is a favour, not a purchase: there is nothing to cancel and nothing to refund, and we can withdraw it at any time.

Everything in My Images stays yours with or without Pro, including the pictures you made with AI. Only Create with AI itself stops.

Section 11. Free use, and limits that can change

Free use carries limits — how many searches you can run in a day, how many pictures you can keep. What those limits are today is on the pricing page, and we may change them, add new features, or retire features as the app grows. If a change would take away something you have already paid for, it will not apply to the period you have paid for.

Section 12. Tracing safely

Trace Mode asks you to hold a phone above a sheet of paper. Stand it on a stable surface or in a holder, and never prop it where it could fall onto you, onto a child, or onto your work. An adult should set the phone up for a child, and stay nearby.

Do not use Sketch Anything while driving, cycling, or doing anything else that needs your attention.

Section 13. Feedback

If you send us an idea for the app, we may use it without owing you anything for it, and without keeping it confidential. Do not send us anything you want to keep to yourself. This does not affect your rights in anything you have already made.

Section 14. Ending this agreement

You can stop using Sketch Anything at any time.

To delete your account, tap Delete Account in Profile. We email you a confirmation link, and nothing is removed until you open it — until then the account is still yours. Once you do open it, we delete your profile, your settings, your saved pictures and the files behind them, the pictures Create with AI made for you and their files, your search history and your usage events. A guest session has no confirmable email address, so Delete Guest Data removes it straight away. What survives deletion, and why, is listed in the data use policy.

We may suspend or end your access if you break this agreement, if we have to for legal or security reasons, or if we stop offering the service. Where we can, we will tell you first and give you a chance to get your pictures out.

These carry on after this agreement ends: Section 3 (what we keep), Section 6 (pictures from the image sources), Section 8 (your content), Section 9 (copyright complaints), Section 13 (feedback), Section 15 (what we do not promise), Section 16 (the limit of our liability), Section 17 (indemnity), Sections 18 and 19 (the Apple and Google Play terms), Section 20 (export controls), Section 21 (governing law) and Section 24 (the rest of the agreement).

Section 15. What we do not promise

The service is provided as is and as available. We work to keep it running, accurate and safe, but we do not promise that a search will always find what you want, that a source will always be available, that a filter will catch everything, that a generated picture will be any good, or that the service will never be interrupted.

To the extent the law allows, we give no warranties of any kind, whether stated or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.

Some laws do not allow these exclusions. Nothing in this section removes a guarantee or a right you have under the consumer law where you live — see Section 21.

Section 16. The limit of our liability

To the extent the law allows:

  • we are not liable for indirect, incidental, special, consequential or punitive loss, or for lost profits, lost data or lost goodwill, however it arises;
  • our total liability to you for everything connected with the service is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 25. That figure is a floor, so that the limit is never nothing; it is not a price, and nothing about it changes what Pro costs.

These limits apply however a claim is framed, and even if we were told the loss was possible.

Nothing here limits liability that cannot be limited by law. That includes liability for death or personal injury caused by negligence, for fraud, and for anything else the law says cannot be excluded. If you are a consumer in the European Union, the United Kingdom or Australia, your statutory consumer guarantees apply in full and this section applies only as far as those laws allow.

Section 17. Covering claims caused by your use

If somebody brings a claim against us because of the way you used the service, because of content you put into it, or because you broke this agreement or the law, you will cover our reasonable costs of dealing with that claim, including legal fees. We will tell you about the claim, let you take charge of defending it where the law allows, and not settle it without asking you. This does not apply where the claim is caused by something we did wrong, and it does not apply to the extent the consumer law where you live says it cannot.

Section 18. If you installed the app from the App Store

These terms apply to you and to us. Apple is not a party to them.

  • The licence. Section 3’s permission is, for an App Store copy, a licence to use Sketch Anything on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions — which includes use by members of your Family Sharing group or through volume purchasing, where those Usage Rules allow it. The licence is not transferable.
  • Third-party terms. You must comply with any applicable third-party terms when you use the app — the image sources’ own terms and the licence on a picture, and your carrier’s terms if you use the app over a mobile network.
  • We, not Apple, are responsible for Sketch Anything and everything in it.
  • Apple has no obligation to provide maintenance or support for the app. Write to us instead — Section 25.
  • If the app fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund what you paid for the app itself, if anything. To the maximum extent the law allows, Apple has no other warranty obligation for the app.
  • We, not Apple, are responsible for dealing with any claim about the app: product liability, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection or privacy law.
  • We, not Apple, are responsible for investigating and defending any claim that the app infringes somebody else’s intellectual property.
  • You confirm that you are not in a country subject to a United States embargo or designated as supporting terrorism, and that you are not on any United States list of prohibited or restricted parties.
  • Apple and its subsidiaries may enforce these terms against you as third-party beneficiaries of them.

Section 19. If you installed the app from Google Play

These terms apply to you and to us. Google is not a party to them, is not responsible for the app, and provides no warranty or support for it. Google Play’s own terms apply to the download and to any purchase you make through it, and a refund for a purchase made through Google Play is handled by Google under its policy.

Section 20. Export controls and sanctions

You may not use the service where United States export law or sanctions forbid it, and you may not use it if you are a person that law forbids us to deal with. You agree not to export or re-export the app in breach of those rules.

Section 21. The law that applies, and where disputes are heard

This agreement, and any dispute arising out of it or out of the service, is governed by the law of the State of California, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

You and we agree that the state and federal courts located in California have exclusive jurisdiction, and we each submit to those courts.

If you are a consumer, that clause cannot take away rights your own law gives you. If the consumer law of the country or state where you live gives you the right to rely on its protections, or to bring proceedings in the courts where you live, those rights stand and this section does not override them. That includes consumers in the European Union and the United Kingdom, and consumers covered by the Australian Consumer Law.

There is no arbitration clause and no class-action waiver in this agreement.

Section 22. Notice to California users

Under California Civil Code section 1789.3, California users are entitled to this notice: the provider of this service is Implicit Labs, Inc., of the address in Section 25. If you want to complain about the service, or want more information about how to use it, write to us at [email protected], or use the contact form. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Sketch Anything is free to download and use. Pro is not on sale yet; when it is, its price will be shown by the App Store or Google Play before you buy, and on the pricing page.

Section 23. Changes to this agreement

We may update this agreement as the app grows. The date at the top of the page says when it last changed. If a change matters to you — a new charge, a real change to what you can do, or a change to how we handle your information — we will tell you in the app or by email before it takes effect, and where the law requires it we will ask you to agree. Carrying on with the service after a change takes effect means you accept it. If you do not accept it, stop using the service and delete your account.

Section 24. The rest of the agreement

  • Severability. If a court finds part of this agreement unenforceable, the rest of it carries on, and that part is narrowed only as far as it has to be.
  • No waiver. If we do not enforce something straight away, we have not given up the right to enforce it later.
  • Assignment. You may not transfer this agreement to anybody else. We may transfer it to a company that buys our business or our assets, and your rights are not reduced by that.
  • No partnership. This agreement does not make either of us the other’s agent or partner.
  • Entire agreement. This document, together with the privacy policy, the data use policy and the image sources page, is the whole agreement between you and us about the service, and replaces anything said before it.
  • Language. This agreement is written in English, and the English version governs.

Section 25. How to reach us

For anything about these terms, about the app, or about a picture:

Implicit Labs, Inc.[email protected]

You can also use the contact form. Copyright notices and requests to take a picture out of the app go to the same support address — see Section 9. Privacy requests, and only those, go to [email protected]; the privacy policy says what to expect.
